Privacy Policy

This Privacy Policy explains what information Fig Performance collects through figperformance.com, how we use it, and the choices you have. Fig Performance is operated by Train With Dan Inc. (“Fig Performance,” “we,” “us”), 1284 E. Yorba Linda Blvd, Placentia, CA 92870.

1. Information we collect

Information you give us

When you use the free consult quiz on our site, we collect:

• Your first name
• Your mobile phone number
• Your email address (optional)
• Your answers: your main goal, the program you’re interested in, your preferred time to train, and any pain or problem areas you choose to select (for example, lower back or knee)
• That you agreed to be contacted by call or text

When you sign your waiver and client checklist

Before your first session, we send you a link to our online signing page to sign our Liability Waiver and Personal Training Client Checklist. When you submit it, we collect:

• Your first and last name, mobile phone number, and email address
• Your emergency contact’s name and phone number
• Your plan details: sessions per week, weekly or monthly billing, start date, commitment end date, and the amounts due
• Your initials on each checklist item, including the health and readiness item, and your agreement to the waiver
• Your typed full legal name as your electronic signature, the signature dates, and your consent to sign electronically
• The date and time you signed, the versions of the documents you signed, and the full text of the documents as you signed them
• If you are under 18, your parent or guardian’s name, relationship to you, phone number, and typed signature

The signing page does not ask for medical records or a diagnosis. If you have a health condition your coach should know about, tell us in person or by phone.

When you pay

Payments are handled by Stripe on its own secure checkout page (see Payments below). Stripe tells us your name, email address, what you bought, the amount, and whether the payment went through. We never see or store your full card number.

If you call, text, email, or message us directly, we receive whatever you choose to share in that conversation.

Please don’t send detailed medical information through the website. The pain-area question is optional and only helps your coach prepare for your consult.

Information collected automatically

We do not use analytics tools, advertising pixels, or tracking cookies on this website, and our site does not set its own cookies. Like any website, the company that hosts our site automatically receives standard technical information when your browser loads a page, such as your IP address, browser type, and the page requested. That information is used to deliver and protect the site. Our pages load no third-party scripts, fonts, or images; the only third-party service your browser contacts from our pages is our form processor, and only when you submit the quiz or the signing form. If you tap a payment link, you leave our site and go to Stripe’s checkout page.

Information stored in your browser

To keep your progress if you go back or reload the page, the quiz saves your answers temporarily in your browser’s session storage, on your own device. Nothing in session storage is sent to us until you tap the submit button. It is cleared when you submit successfully, and your browser deletes it automatically when you close the tab.

2. Third-party services the site uses

• FormSubmit (formsubmit.co). When you submit the quiz or the signing form, your answers are sent to FormSubmit, a third-party form processor, which delivers them to us by email. Your signed waiver and checklist arrive as an email to Fig Performance (Train With Dan Inc.), and that email is our signed record. Quiz and signing notifications are delivered to an email inbox hosted by Google (Gmail), and email you send to trainat@figperformance.com is handled by our business email provider. FormSubmit’s own privacy policy applies to its handling of the data.
• Stripe (stripe.com). Stripe processes our payments through its hosted checkout page. See Payments below.
• Fonts. Our fonts are hosted on our own website, so loading a page does not send requests to Google Fonts or any other font service.
• Website hosting. Our hosting provider processes standard technical request data (described above) to serve the site.
• Links to other sites. “Get directions” links open Google Maps, and we link to our Instagram profile. Those sites only receive information if you click through, and their own privacy policies apply.

3. Payments

When you pay for training, you use a secure checkout page hosted by Stripe, not a form on our website. You type your card or payment details directly into Stripe, so Fig Performance never sees or stores your full card number. Stripe shares with us only what we need to run your account, such as your name, email address, the plan you chose, the amount, the last four digits and type of card, and whether the payment succeeded.

If you pay with Apple Pay, or choose Klarna or Affirm on a prepaid package, that company also handles your payment, and it may check your eligibility. Stripe, Apple, Klarna, and Affirm each have their own privacy policies, which apply to the information you give them.

4. How we use your information

• To contact you about the free consult you requested, and to schedule it
• To answer your questions and send you information about our programs, pricing, tours, and events (such as our grand opening)
• To prepare for your consult, including any pain or problem areas you shared
• To keep a signed record of your waiver and client checklist, and to reach your emergency contact if needed
• To set up your plan, take payments, send receipts, and keep billing records
• To provide and improve our services, keep records, and meet legal obligations

5. How we share information

We do not sell your personal information, and we do not share it for cross-context behavioral advertising. Inside Fig Performance, your signed documents and payment records are seen only by Dan Figueroa, the owner. We share information only with service providers we need to run the business, such as our form processor, email provider, payment processor (Stripe), and website host, and only so they can provide those services to us. We may also disclose information if required by law, to protect our rights or the safety of others, or as part of a sale or reorganization of the business.

6. Calls and text messages (SMS)

By submitting the quiz with your mobile number, you agree that Fig Performance may call or text that number about your consultation and our services. Message frequency varies. Message and data rates may apply. Reply STOP to opt out of texts at any time, or HELP for help. You can also ask us to stop calling. Consent to receive calls or texts is not a condition of purchase.

We do not share your mobile number or text-messaging consent with third parties for their marketing or promotional purposes.

7. How long we keep information

We keep your information only as long as we reasonably need it for the purposes above, such as following up on your consult and, if you join, providing your training. We also keep it for as long as required for legitimate business or legal reasons. After that, we delete it.

Signed waivers, client checklists, and payment records are kept for as long as you train with us, plus 7 years after your last session. We keep them that long because they are legal and tax records. Consult quiz answers from people who don’t become clients are deleted when we no longer need them to follow up.

You can ask us to delete your information sooner (see below). We’ll delete what we can, but we may need to keep signed agreements and payment records for the period above.

8. Your rights, including California privacy rights

You can ask us to access, correct, or delete the personal information we hold about you at any time. If you are a California resident, the California Consumer Privacy Act, as amended by the CPRA, gives you the right to:

• Know what personal information we collect, use, and disclose, and to get a copy of it
• Delete personal information we collected from you, subject to legal exceptions
• Correct inaccurate personal information
• Opt out of the sale or sharing of personal information. We don’t sell or share it, so there is nothing to opt out of.
• Limit the use of sensitive personal information. If you share pain or problem areas or health information, we use them only to provide the services you asked for.
• Not be discriminated against for exercising these rights

How to make a request: email trainat@figperformance.com with the subject “Privacy request,” or call or text (714) 396-7178. Tell us what you’re asking for, for example “please send me a copy of my signed waiver” or “please delete my information.” We may need to confirm your identity, for example by contacting you at the phone number you gave us. An authorized agent may make a request on your behalf with your written permission. We will respond within the time required by law.

California’s “Shine the Light” law: we do not disclose personal information to third parties for their own direct marketing purposes.

9. Children

Our site and services are intended for adults. Clients under 18 may train only with a parent or guardian’s permission, and the parent or guardian must also sign the waiver and checklist. We do not knowingly collect personal information from children under 13. If you believe a child has sent us information, contact us and we will delete it.

10. Security

We use reasonable measures to protect your information, and our site is served over an encrypted (HTTPS) connection. Card payments go through Stripe’s secure checkout, so card numbers never pass through our website or inbox. No method of transmission or storage is 100% secure, so we can’t guarantee absolute security.

11. Changes to this policy

We may update this Privacy Policy from time to time. When we do, we will post the new version on this page and update the effective date above. If a change is significant, we will take reasonable steps to let you know.
